The United Kingdom Civil Dispute System
(Aarti Narang)
The United Kingdom Civil Dispute System Thanks to Lord Woolf?s 1986 report, ?Access to Justice?, which proclaimed a need for a fair, fast, and commensurable resolution, there has come about a surge in the use of Alternative Dispute Resolution. This method emphasizes on settlement, in the hopes that this will prevent the need for court proceedings, which is considered much better for court users. The five-year strategy, enforced by the Department for Constitutional Affairs, currently presses for the use of Alternative Dispute Resolution. This is an effort to supply the public with the services and knowledge they need to effectively negotiate their disputes. This method of dispute resolution is being employed in an attempt to better serve the public interest. There is little information available to help an individual settle a dispute; therefore it is in the interest of the public for the Department for Constitutional Affairs to supply a better method of resolution to any civil dispute. There are much easier, and quick methods available to any user of the court. Mediation is available at three county courts. These courts include Manchester, Reading, and Exeter. The mediation systems set up at these courts can help small claims court users who do not have a solicitor. This can help users to prepare for a hearing if mediation is not able to resolve their dispute. A National Mediation help line has been provided to any court user in England and Wales with a need for information on mediation. This number is 0845 60 30 809. It has a stellar track record, with over 1000 phone calls received and several successful mediations every month. The service is available Monday to Friday, from 8:30 am to 6:00 pm. Through a few simple questions; you will be referred to one of the supporting courts for continued help in your dispute.
